RULING BY OTHER THAN WHAT ALLĀH REVEALED

*CHALLENGING THE DIVINE RULE*

Believing in Allāh (ﷻ) and worshipping Him requires submission to His judgement, acceptance of His laws, and referral to the Qur'ān and Sunnah of the Prophet (ﷺ) in disputes concerning statements, fundamentals, litigations, blood, properties, and other rights. Allāh is the Ultimate Judge, and judgement ultimately belongs to Him. Therefore, it is incumbent upon the rulers to rule by what Allāh (ﷻ) has revealed, and it is incumbent upon the subjects to seek judgement from the Book of Allāh and the Sunnah of His Messenger (ﷺ). Allāh says:

(Interpretation of the meaning) 
_*“O you who believe, obey Allāh and obey His Messenger, and the people in authority among you. And if you dispute over anything, refer it to Allāh and His Messenger if you really believe in Allāh and the Last Day that is best in terms of consequences. ”*_
[An-Nisa' 4:59] 

_*“Verily, Allāh commands you to deliver the trust committed to you to their due owners, and that when you judge between people, to judge with justice.”*_
[An-Nisa' 4:58] 

Allāh (ﷻ) has made it plain that seeking judgement outside of what He has revealed is contrary to islam.

According to Allāh's words in An-Nisa' 4:60, those who pretend to believe in what the Qur'ān revealed and seek judgement from the Taghut (idol, false gods) are disbelievers.

Muslims will become sincere believers if they use the Messenger (ﷺ) as a judge in their disputes and have no issue accepting his judgement. Allāh (ﷻ) emphasises the lack of faith of people who do not take their disagreements to Allāh's Messenger (ﷺ) and accept his decision. 

Allāh (ﷻ) also decreed that rulers who do not govern in accordance with what Allāh sent down are unbelievers, wrongdoers, and rebels. This is in accordance to Al-Ma'idah' 5:44 -45, Al-Ma'idah' 5:47.

It is necessary to rule by what Allāh (ﷻ) has revealed and to seek His judgement in all cases of dispute. Scholars' opinions should only be accepted if they are substantiated by the Qur'ān and Sunnah. Personal statutes related to Islam in some countries must apply to all litigation and rights, not just personal statutes. Islam is one entity that is indivisible.

The adherents of jurisprudential schools must also refer the statements of their Imams to the Qur'ān and Sunnah to accept only those of them that are in conformity with these two sources, and reject the rest, without prejudice or bias, particularly in matters of Aqeedah. The Imams recommended doing so strongly. This is the real Madh'hab of all the Imams. Therefore, he who opposes them is not considered as their adherent, even if he claims to be so. Rather, he would be going against the real Madh'hab.

In conclusion, it is important to rule by what Allāh (ﷻ) has revealed and seek His judgement in all cases of dispute. Adhering to the Qur'ān and Sunnah is necessary for all believers, regardless of their jurisdictional schools. Following the Imams is essential, but they must be referred to the Qur'ān and Sunnah to ensure they are in accordance with these sources. This is the true Madh'hab of all Imams. Going against them is not following the Madh'hab, but rather, it goes against it. Therefore, rulers and subjects must ensure they rule and seek judgement according to Allāh's revelation.
